PREAMBLE

COSMETO NATURE is an online trading shop providing beauty products on the website www.cosmeto-nature.com. Cosmeto Nature’s head office is located at 100 rue Louis Blanc 60100 Montataire France, VAT Reg. N°: 810 492 546 00017.

1. PURPOSE 

The actual General Terms and Conditions of Sales are applied exclusively to actual and futures commercial relations existing between:

Cosmeto Nature (hereunder named “THE SELLER”) and the buyer placing the order (hereunder named “BUYER” or “THE CUSTOMER”) for all transactions on the website.

These terms purposes are on one hand to inform the customer about selling mode and conditions of delivery of orders and on other hand to define the rights and obligations of both parties.

These terms are applied without any restrictions or reserves on all products sold by COSMETO NATURE on its website.

COSMETO NATURE Company reserves, anytime, the right to modify these actual General Terms of Sale, subject to mentioning it on its website. In that case, the applied conditions will be those of the Buyer’s order date.

These Terms are fully under acceptance of the Buyer without any restrictions or reserves for any order placed on website of www.cosmeto-nature.com

2. ORDER

All products available on Cosmeto Nature website can be followed by each customer without obligation of purchase. All Website connexion fees are at Customer or Buyer’s costs.

Each purchase order assumes the acceptance, without any restriction or reserves, to actual General terms of sales.

The order placed on www.cosmeto-nature.com means to record the Buyer’s delivery place and billing details, the delivery mode and payment mode and by settlement of due amount.

When the Buyer confirms its order by clicking the button « CHECK OUT», the Buyer declares the fully acceptance without reserves of the order and all Sales Conditions. Each recorded order will provide an acknowledgement of receipt which will be sent to e-mail address of the customer. This acknowledgement of receipt means and confirms acceptance and validation of order.

Cosmeto Nature shall have the right to cancel or suspend any order with a buyer’s, in case of payment litigation happened on past orders or potential risks or fraudulent.

3. PRODUCTS

As per article L.111-1 of Consumer code, the user shall acknowledge, before each order, about main features of the products on Cosmeto nature website.

Cosmeto Nature provides all selling items with features. However, part of information could be incomplete or not in ad equation with customer’s requirements. Nevertheless, for all additional information requested by customers regarding a product, it is permitted to send a mail to contact@cosmeto-nature.com before the purchase order.

The choice and purchase on the website remains under the responsibility of the customer.

The Vendor will not be held responsible of any direct or indirect damage consequently non-compliant using or inappropriate conservation of the product.

All products on our Website are submitted to stock availability. Cosmeto Nature shall have the right to amend the assortment of products in case of its constraints or lacks.

The Pictures, graphics and descriptions have been issued in order to introduce the best status of the product.

In case of packaging modification by a potential supplier which will not affect the product itself, the selling will not be suspended and the Vendor assumes the modification of Graphic on its website.

4 .PRODUCTS AVAILABILITY

Cosmeto Nature makes all effort to ensure the products availability but is under available stock limit.

The status of availability of a product is indicated during a product view ; in case of unavailable product after the order placed, the Vendor will inform the customer at the soonest time. The customer may then cancel or modify its order.

In case of unavailable product after order placed, Cosmeto Nature will refund the overpayment.

5. PRICE

All prices, on the website Cosmeto Nature, are in EUROS and taxes included (incl.VAT) or pre.taxes prices and delivery charges according delivery address .The applied VAT rate is the one at the time of the order.

For France and European Union (after customer filled out its delivery address): prices are taxes included (incl.VAT) and other countries prices are pre.taxes.

Cosmeto Nature shall have the right to modify its prices at any time but agrees to apply the tariffs pointed out to customer at order placing.

6. PAYMENT

All payment must be made at order placing by the Buyer.

All orders payment is in EUROS .The Buyer certifies having all authorizations to use the payment mode chosen by himself during the order recording.

Cosmeto nature shall have the right to suspend or cancel any order or delivery, whatever the nature or level, in case of non-payment by the Buyer or any litigation with payment mode or with the Buyer.

For the payment, the Buyer could use: bank card, bank check, swift bank transfer, warrant, Paypal, gift card.

Payments by bank card are made by PayPal or System Pay (Banque Populaire): all modes of payment are secured and each purchase confirmed by mail.

This mode of payment involves the debit on date of order.

We do not keep the bank datas or bank card datas after payment.

In case of Check payment, the Buyer will issue the check to the order of: « COSMETO NATURE ». On the back of the check, the order number will be requested and mentioned .The check will be sent by courier to following address:

The order can be cancelled before the check is sent: an e-mail has to be sent to the customer service of Cosmeto Nature by confirming the order reference.

In case the Buyer will pay by bank transfer or Money Order, the order reference has to be mentioned.

Cosmeto Nature will send the goods once the reception of funds corresponding to order is done.

7. DELIVERY

Cosmeto Nature shall do the necessary to deliver the goods on the soonest time. Orders are prepared and shipped under 72 opened hours after confirmed order date, then delivered by Colissimo (La poste) under 48 Hours for France .The transit time after order date is also 5 opened days maximum for France .

For other countries, delivery is also made by Colissimo (DOM/TOM, Europe or International), the transit time of delivery depends on each country .

The goods are shipped to the delivery address confirmed by the buyer when the order is made and full information of address is needed for the right service and delivery. All potential risks are transferred to buyer from date of delivery.

-For France, delivery charges are 4,99€ TTC minimum, Franco from 60€ TTC purchases.

-For other countries and DOM/TOM, the delivery charges are calculated based on delivery place and weight of the package.

Buyer will automatically receive an e-mail when package leaves the warehouse.

For France, the delivery is done via LA POSTE with or without signature (package put in postal box) or relay point.

For other countries, package delivered cons of signing. In case of absence, a notice of passage is remitted and the package is deposit in the closer Post office. In case the package is not reclaimed during the time permitted by the Post Department( 15 days) , the package will be returned to the shipping warehouse of the Vendor ; the return charges will be billed to Buyer .The ordered products will be either refunded ( account credited – assets or check) or re-shipped but will adding charges will be billed to buyer .

In case Cosmeto Nature has no news from buyer regarding a returned package during the 90 days after receipt of cargo on warehouse, neither refund or re-shipping of package will be done.

In case buyer chooses the withdraw mode of order (in Montataire city), delivery charges will be free and the buyer shall contact the Vendor before taking the package. In case Buyer could not take back the order for any reason, Cosmeto Nature will declare status of order as « payment litigation » and buyer will have to pay the delivery charges to receive its order .The status of the order will stay as « payment litigation » until reception of delivery charges payment.

At delivery of order, Buyer shall have to check with driver the condition of the package and its content.

If any matter or doubt regarding the package or its content, the Buyer is required to:

-Apply Colissimo Process (especially to report damages, claims and reserves) and refuse the cargo by issuing a claim report to LA Poste department officer (statement 170) or to the closest post office within 48 hours after receipt of cargo.

-To report by mail this claim within 48 hours to Cosmeto Nature by mentioning the Order Number.

In case the goods have been damaged during transportation, Cosmeto Nature has to be informed as soon as possible in order to solve the matter.

In case the delivered product does not correspond to the order or a product is missing, the buyer shall have to inform Cosmeto Nature immediately.

Cosmeto Nature shall not be considered in default in the performance of its obligations on delivery in Force Majeure cases (strikes, floods, blazes...)

No claim (lost cargo, not delivered, damaged...) will be accepted after legal notice of 90 days following the shipping of order par the Vendor.

8. RETRACTATION

Cosmeto Nature Company is submitted to Home Demarch legislation under the law L.121-21 of the Consumer Code to be consulted on website www.legifrance.gouv.fr

The Buyer has 14 days from the delivery date of goods to return back, at its costs, the ordered products for refund. In case of Saturday, Sunday or Public Holiday, it is postponed to the next opened day.

When an order is turned back, all risks related to product turn back are at Buyer’s costs.

Cosmeto Nature will swap the product or will refund the amount to Buyer, within 14 days after reception of turned back products,

Exception: In case of purchase in Commercial partner (Bulk purchase site – ex: GROUPON, LOOKINGO...)

The retract limit time will be applied from date of reception of products by the customer and to be argue with him .The refund will be equal to amount paid on the website.

To return an item, the buyer should inform Cosmeto Nature Company. It can be done by mail or phone by confirming the order reference: by phone + 33 9 73 64 32 41 (from Monday to Friday 10 to 17 (GMT/UTC+1)).

Cosmeto Nature will not accept any parcel under collect terms. Any incomplete, damaged or in bad condition item will be refused. 

9. PROPERTY RESERVE

All delivered products remain Cosmeto Nature’s property until the Buyer fill out his obligations and specially the full payment of the ordered products.

10. INTELLECTUAL PROPERTY

All elements of Cosmeto Nature website remain Cosmeto Nature’s intellectual and exclusive property.

The Reproduction, Operating and Supplying of Software, visual and acoustic elements of Website   , even partially, are totally forbidden.

11. LIABILITY

All provided products are in accordance with the French legislation in force.

Cosmeto Nature cannot be held liable for non-compliance with the legislation of the country where the products are delivered. It is the buyer's responsibility to check with the local authorities the possibilities of importing or using the products or services he intends to order.

The pictures and the texts reproduced and illustrating the products may present some discrepancies with the actual packaging.

Cosmeto Nature cannot be held liable because of the nature of the products sold or because of the advice provided

Consequently, the responsibility of the seller or of his owners cannot be sought by the user either because of the products sold or because of the implementation of the advice provided. The user acts under his / her sole and exclusive responsibility.

12. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are subject to French law. This is an English translation of the main Terms and conditions of the French version of Cosmeto Nature which can be found here. The language of this contract is English. All disputes relating to the commercial relationship between the buyer and the seller are subject to the exclusive jurisdiction of the French courts and will be under the exclusive jurisdiction of the Commercial Court.
